Vocal Objection

The attorney for JOHN FACENDA JR. says the lawsuit his client has filed against the NFL, NFL FILMS INC. and
NFL PROPERTIES LLC, isn't so much about money as it is about principle.

JOHN FACENDA, the longtime voice of NFL FILMS who was
71 when he died of cancer in 1984, is seeking "in excess of $150,000" for copyright infringement in the suit filed this week in U.S. District Court.

The younger Facenda, who lives in Whitehall, Pennsylvania, south of Pittsburgh, claims the defendants made unauthorized use of his father's voice in a commercial promoting the Madden 2006 video game, which went on sale last August 9th.

"In 1980, John Facenda signed a contract with NFL FILMS," said PAUL LAURICELLA, of THE BEASLEY LAW FIRM
in Center City.

"That contract specifically states, in Mr. Facenda's words,
'I give (NFL Films) permission to use my voice so long as it does not constitute an endorsement of a product or service.'
